1. Acceptance of Terms

By downloading, installing, accessing, or using the HueCheck mobile application ("App") or any related services, you agree to be bound by these Terms and Conditions ("Terms"). These Terms constitute a legally binding agreement between you and HueCheck.

If you do not agree to these Terms, you must not access or use the App. We recommend that you print or save a copy of these Terms for your records.

2. Description of Service

HueCheck is a mobile application that uses artificial intelligence to provide:

  • Seasonal color palette analysis based on your photos
  • Personalized color recommendations
  • Color matching feature (HueCheck) to evaluate clothing and products
  • Hair color recommendations
  • Virtual try-on features
  • Full palette view with comprehensive color guidance

The App uses AI technology to analyze photos you provide and generate personalized recommendations. Results are for informational and entertainment purposes and should not be considered professional styling, medical, or cosmetic advice.

3. Eligibility

To use HueCheck, you must:

  • Be at least 13 years of age (or 16 in the European Economic Area)
  • Have the legal capacity to enter into a binding agreement
  • Not be prohibited from using the App under applicable laws
  • Provide accurate and complete registration information

If you are under 18, you represent that you have your parent or guardian's permission to use the App and that they have read and agreed to these Terms.

4. User Accounts

4.1 Account Creation

To access certain features, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate.

4.2 Account Security

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized access or security breach

4.3 Account Termination

You may delete your account at any time through the App settings or by contacting us. We reserve the right to suspend or terminate your account if you violate these Terms or engage in conduct that we determine to be harmful to HueCheck or other users.

5. User Content and Photos

5.1 Your Content

By uploading photos or other content to the App, you:

  • Represent that you own or have the right to use such content
  • Grant HueCheck a non-exclusive, worldwide, royalty-free license to use, process, and analyze such content solely for providing our services to you
  • Understand that your photos will be processed by AI systems

5.2 Content Restrictions

You agree not to upload content that:

  • Infringes on any third party's intellectual property or privacy rights
  • Contains images of individuals without their consent
  • Is illegal, harmful, threatening, abusive, or otherwise objectionable
  • Contains malware, viruses, or other harmful code

5.3 Photo Deletion

You can delete your photos at any time through the App. When you delete photos or your account, we will remove your content from our active systems within 30 days, except where retention is required for legal purposes.

6. Subscriptions and Payments

6.1 Free and Premium Features

HueCheck offers both free and premium features. Premium features require a paid subscription. Free features may be limited in functionality.

6.2 Subscription Terms

  • Subscriptions are billed in advance on a monthly or annual basis
  • Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period
  • You can manage and cancel your subscription through your device's app store (Apple App Store or Google Play Store)
  • Prices may change with reasonable notice; changes will apply to subsequent billing periods

6.3 Refunds

Refunds are handled by Apple App Store or Google Play Store according to their respective refund policies. We do not process refunds directly.

  • Apple: Request refunds through Apple's Report a Problem page or contact Apple Support
  • Google: Request refunds through Google Play within 48 hours of purchase, or contact Google Play Support for later requests

6.4 Free Trials

If you sign up for a free trial, your subscription will automatically convert to a paid subscription at the end of the trial period unless you cancel before the trial ends. You will be charged the applicable subscription fee at that time.

7. Acceptable Use

You agree to use the App only for lawful purposes and in accordance with these Terms. You agree NOT to:

  • Use the App in any way that violates applicable laws or regulations
  • Attempt to gain unauthorized access to our systems or other users' accounts
  • Use the App to transmit malware, viruses, or other harmful code
  • Interfere with or disrupt the App or servers
  • Use automated scripts, bots, or scraping tools to access the App
  • Reverse engineer, decompile, or disassemble any part of the App
  • Use the App to harass, abuse, or harm others
  • Impersonate any person or entity
  • Use the App for any commercial purpose without our written consent

8. Intellectual Property

8.1 Our Intellectual Property

The App and its entire contents, features, and functionality (including but not limited to all text, graphics, logos, icons, images, audio clips, software, and the design, selection, and arrangement thereof) are owned by HueCheck and are protected by copyright, trademark, and other intellectual property laws.

8.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on your personal device solely for your personal, non-commercial use in accordance with these Terms.

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Warranties of merchantability or fitness for a particular purpose
  • Warranties that the App will be uninterrupted, secure, or error-free
  • Warranties regarding the accuracy, reliability, or completeness of any content

Important: Color analysis results, virtual try-on images, and all recommendations are AI-generated and are for informational and entertainment purposes only. They should not be considered:

  • Professional styling or fashion advice
  • Medical or dermatological advice
  • Guarantees of how colors will appear in real life

Results may vary based on photo quality, lighting conditions, device display settings, and other factors.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HUECHECK AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Any loss of profits, revenue, data, or goodwill
  • Any damages arising from your use of or inability to use the App
  • Any damages arising from unauthorized access to your account or data
  • Any damages arising from third-party content or services

In no event shall our total liability exceed the amount you paid us in the twelve (12) months preceding the claim, or $100 USD, whichever is greater.

11. Indemnification

You agree to indemnify, defend, and hold harmless HueCheck and its officers, directors, employees, agents, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to: (a) your use of the App; (b) your violation of these Terms; (c) your violation of any third party's rights; or (d) any content you submit to the App.

12. Third-Party Services

The App may contain links to or integrations with third-party websites, services, or content. We do not control and are not responsible for third-party services. Your use of third-party services is at your own risk and subject to their terms and privacy policies.

13. Modifications to the App and Terms

13.1 App Changes

We reserve the right to modify, suspend, or discontinue the App (or any part thereof) at any time with or without notice. We shall not be liable to you or any third party for any such modification, suspension, or discontinuation.

13.2 Terms Changes

We may revise these Terms at any time. Material changes will be communicated through the App or by email. Your continued use of the App after changes become effective constitutes your acceptance of the revised Terms.

14. Termination

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination: (a) your right to use the App will immediately cease; (b) we may delete your account and data; (c) all provisions of these Terms that by their nature should survive termination shall survive (including ownership provisions, warranty disclaimers, indemnity, and limitations of liability).

15. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which HueCheck is incorporated, without regard to its conflict of law provisions.

Any disputes arising from or relating to these Terms or the App shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to binding arbitration in accordance with applicable arbitration rules, except where prohibited by law.

16. General Provisions

16.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and HueCheck regarding the App.

16.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

16.3 Waiver

Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.

16.4 Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.
