HueCheck ("we," "our," or "us") is committed to protecting your privacy. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you use our mobile application ("App") and related services.

By using HueCheck, you consent to the data practices described in this policy. If you do not agree with the terms of this Privacy Policy, please do not access or use the App.

2. Information We Collect

2.1 Personal Information

When you create an account, we collect:

• Email address (required for account creation)
• Name (optional)
• Profile picture (optional)
• Password (encrypted and securely stored)

2.2 Biometric and Visual Data

To provide our color analysis services, we collect and process:

• Face photos for skin tone, eye color, and facial feature analysis
• Wrist/arm photos for vein color undertone analysis
• Fabric draping test photos
• Full body photos for virtual try-on features
• Clothing and product photos for color matching

Important: We do not use facial recognition technology to identify individuals. Our AI analyzes color characteristics only and does not create biometric identifiers that could be used to identify you.

2.3 Usage Data

We automatically collect certain information when you use the App:

• Device information (device type, operating system, unique device identifiers)
• App usage data (features used, time spent, interactions)
• Log data (IP address, access times, error logs)
• Analytics data to improve our services

2.4 Payment Information

Payment processing is handled entirely by Apple App Store or Google Play Store. We do not collect, store, or have access to your credit card numbers or payment details. We only receive confirmation of successful transactions and subscription status.

3. How We Use Your Information

We use the information we collect to:

• Provide AI-powered seasonal color analysis
• Generate your personalized color palette
• Perform color matching (HueCheck feature)
• Provide hair color recommendations
• Generate virtual try-on images
• Create and manage your account
• Process and manage subscriptions
• Send service-related communications (e.g., password reset, important updates)
• Respond to your inquiries and support requests
• Improve and optimize our App and services
• Detect and prevent fraud or abuse
• Comply with legal obligations

4. Photo Processing and AI

Your photos are processed using artificial intelligence to analyze color characteristics. Here's how we handle your photos:

• Processing: Photos are analyzed by our AI systems to extract color data
• Storage: Photos are stored on secure, encrypted servers
• Retention: Photos are retained while your account is active
• No AI Training: Your photos are NOT used to train AI models
• No Sharing: Your photos are never shared with third parties for marketing

You can delete individual photos or all your photos at any time through the App settings.

5. Data Sharing and Disclosure

We may share your information in the following circumstances:

• Service Providers: We work with trusted third-party service providers who assist us in operating our App, including cloud hosting (Supabase), AI processing, and analytics providers. These providers are contractually obligated to protect your data.
• Legal Requirements: We may disclose your information if required by law, court order, or government request, or when we believe disclosure is necessary to protect our rights, your safety, or the safety of others.
• Business Transfers: If HueCheck is involved in a merger, acquisition, or sale of assets, your information may be transferred as part of that transaction. We will notify you of any such change.
• With Your Consent: We may share your information for other purposes with your explicit consent.

6. Data Security

We implement industry-standard security measures to protect your data:

• Encryption of data in transit (TLS/SSL) and at rest
• Secure authentication mechanisms

While we strive to protect your personal information, no method of transmission over the internet or electronic storage is 100% secure. We cannot guarantee absolute security.

• Account Data: Retained while your account is active and for up to 30 days after deletion
• Photos: Retained while your account is active; deleted within 30 days of account deletion or upon your request
• Color Analysis Results: Retained while your account is active
• Usage Data: Retained for up to 24 months for analytics purposes
• Legal Compliance: Some data may be retained longer if required by law

8. Your Rights and Choices

Depending on your location, you may have the following rights regarding your personal data:

• Access: Request a copy of your personal data
• Correction: Request correction of inaccurate data
• Deletion: Request deletion of your data
• Portability: Request your data in a portable format
• Restriction: Request restriction of processing

9. Account Deletion

You can delete your account at any time. Here's what happens when you delete your account:

• Your account will be immediately deactivated
• Your personal information, photos, and analysis results will be scheduled for deletion
• Data will be permanently deleted from our systems within 30 days
• Some anonymized, aggregated data may be retained for analytics
• Data required for legal compliance may be retained as required by law

How to Delete Your Account:

1. Open the HueCheck app
2. Go to Settings > Account
3. Tap "Delete Account"
4. Confirm deletion by entering your password
5. Your account will be permanently deleted

Alternatively, you can request account deletion by emailing privacy@huecheck.app from the email address associated with your account.

10. California Privacy Rights (CCPA)

If you are a California resident, you have additional rights under the California Consumer Privacy Act (CCPA):

• Right to know what personal information we collect and how it's used
• Right to delete your personal information
• Right to opt-out of the sale of personal information (we do not sell your data)
• Right to non-discrimination for exercising your privacy rights

We do not sell your personal information.

11. European Privacy Rights (GDPR)

If you are in the European Economic Area (EEA), United Kingdom, or Switzerland, you have rights under the General Data Protection Regulation (GDPR):

• All rights listed in Section 8 above
• Right to lodge a complaint with a supervisory authority
• Right to withdraw consent at any time

Legal Basis for Processing: We process your data based on: (a) your consent, (b) performance of our contract with you, (c) our legitimate interests, or (d) compliance with legal obligations.

HueCheck is not intended for children under 13 years of age (or 16 in the EEA). We do not knowingly collect personal information from children under these ages.
